Shipping, payment and returns

"terms" means these terms of sale as well as any other terms and conditions that we specify from time to time. 
"we", "our" and "us" means Abalner Pty Ltd ACN 002 575 626.
"website" means or such other domain name as we choose from time to time whether accessed through a computer, a mobile device or otherwise.
 "you" means you as a user of our website or our customer.


All tyres are sold subject to our standard conditions of sale. These are printed on the reverse of your invoice, and a copy is available here. You agree to be bound by our standard conditions of sale and these terms and you agree that they will govern your use of the website and your purchase of goods and services from us. If you do not agree to be bound by our standard conditions of sale and the terms, you must cease using our website and you must cease using and not use our goods and services. We may vary the terms from time to time at our sole discretion therefore we encourage you to review them regularly. 


Ownership of goods you purchase from us does not pass to you until payment has been received in full for such goods and any associated services. Risk of loss or damage to goods passes to you upon delivery or installation of such goods. We cannot guarantee the availability of any goods and services advertised or promoted by us. You are responsible for ensuring that all measurements and vehicle specifications that you provide to us are accurate and correct.

Tyre Fitting

The fitting charge quoted is per tyre and includes balancing, tubeless valves and disposal of the old tyre, if required. 
Once you place your order, we will contact you within one business day to confirm that your selected tyres are in stock, and then you can come in at any time during our opening hours for priority fitting within 60 minutes. In most cases, we will either have your selected tyres in stock at our workshop, or be able to have them in stock within one business day from the time your order is placed. If this is not the case we will contact you to let you know when we expect to have the tyres available.

Shipping costs

The cost of shipping and handling within Australia varies widely depending on your location and the size of your order. To see what your shipping costs will be, add the items to your cart, select the ‘ship to me’ option and enter your delivery address. In some cases, particularly for rural postcodes, our online delivery calculator may not be able to accurately calculate your shipping charges. These instances are rare but should this arise, we will get in touch with you to let you know. Courier deliveries

We use a courier service for secure and reliable deliveries. We prefer to ship goods to business addresses as it is more likely that someone will be able to sign for them. If you would like your order shipped to a residential address, you authorise the courier to leave your order in a safe place at your address without a signature, unless you advise us otherwise. We will not be responsible for items once the status of the order is ‘delivered’.  If you are not home when the courier attempts to deliver, they will look for a safe place to leave the order. You may request a particular spot, or advise us you would not like your order left unattended, in the ‘Additional Shipping Information’ section. Requests cannot be guaranteed. If the courier cannot see a safe place to leave your goods, they will leave a card and take the parcel to the local depot for you to collect. 

If you are not home and you have not given authority to leave the parcel, you will have to contact the carrier to organise a redelivery. This may incur an additional fee to you.

Delivery timeframes

We despatch in stock items daily from Sydney and most orders will go out the day after the order is received. Most orders are sent via courier and delivery to major cities on the east coast will take approximately 1-3 days. Items going to Adelaide can take 3-4 days and items to Perth can take around 5 days. These timeframes are not guaranteed by us or by our courier.

We accept payment by Visa, Mastercard or through PayPal. Once you confirm your order, you can choose to either pay securely by credit card or be directed to the PayPal website to pay with your PayPal account. If you have any queries or concerns, please do contact us for assistance.



If you would like to cancel your order before it has been shipped or fitted, we may offer you a refund. In certain circumstances, particularly for uncommon tyres or wheels, we may not be able to offer you a full refund depending on the return policy of our supplier. If your order has already been shipped, please refer to the When you have changed your mind section below.

Please contact us as soon as possible if you would like to cancel your order.

Returns and refunds

When items are damaged, faulty or wrongly described:

If items delivered are damaged or faulty, please contact us within 24 hours of delivery. We usually request photos to confirm that the item is faulty, damaged or not as described but we do reserve the right to request that items be returned at your cost for inspection before issuing a refund.

Upon confirmation by us, you may choose between a replacement or a refund. We will make arrangements for the original items to be returned to us if you have not already sent them back to us.

When you have changed your mind, or selected the wrong product:

We encourage all customers to check their tyre size and other relevant specifications prior to placing their order, and we are happy to help with this if you need it. If you select the wrong size, please contact us. We will be happy to offer you a refund less the cost of shipping, or an exchange for the correct size.

If you choose a refund, please be aware that the original shipping costs will not be refunded, and you will also be responsible for the shipping costs to return the items to us. We will clearly state the amount you can expect to be refunded before arranging to collect the items from you. Once the items have been returned to us and checked, your refund will be processed.

If you choose an exchange, please be aware that there may be a price difference between your original item and the replacement. Any difference, along with the additional shipping costs, must be paid prior to the replacement or exchanged items being shipped to you.

Refunds and exchanges will not be processed until the items have been returned to us and checked. Please contact us prior to returning your order so that we can advise you whether a return will be accepted by us and how to go about returning items.

Whether you choose a refund or exchange, the original order must be returned to us.

Limitation of liability and release

To the maximum extent permitted by law our liability to you arising from the supply of goods or services or your use of goods or services supplied to you by us is limited to: (i) if goods: (A) the replacement of the goods or the supply of equivalent goods; (B) the repair of such goods; (C) the payment of the cost of replacing the goods or of acquiring equivalent goods; or (D) the payment of the cost of having the goods repaired; and (ii) if services: (A) the supplying of the services again; or (B) the payment of the cost of having the services supplied again.

You agree to indemnify and hold, and to continue to indemnify and hold, us, our directors, officers, agents, employees and contractors (Those Indemnified) harmless from all claims, losses, damages, demands and expenses (including legal costs and disbursements) against Those Indemnified by anyone arising out of: (i) any injury to a person, death of a person or damage or destruction of property that was connected to your or anyone else’s use of the services or goods purchased from us; (ii) any falsehood, error or inaccuracy contained in any information you provided to us; and/or (iii) your breach of any of your obligations that are specified in these terms, except to the extent that we are grossly negligent.

Protecting your account

You are responsible for maintaining the confidentiality of any online user account details and password that you create with us. You agree to not disclose those details to any third party and that you are solely responsible for all activity in relation to your user account, whether or not you have authorised such activity. You agree not to let others use your user account. You must notify us immediately of any unauthorised use or any other breach of security in relation to your user account.



We do not guarantee that your computer or mobile device will not be affected by a computer virus or malicious program during your use of our website. We recommend that you use appropriate firewall and anti-virus protection. You warrant and represent that you have taken all reasonable precautions to ensure that any information or data that you submit via our website (and by email to us) does not contain any virus or anything else which might have an adverse impact on our website, our services or our computer systems.


Intellectual Property

Unless otherwise expressly indicated, all intellectual property rights in all content (including but not limited to all images, text, videos) on the website are owned or licensed by us. For the purposes of these terms "intellectual property rights" means any and all rights in intellectual property throughout the world including but not limited to copyright, inventions (including patents), trade marks or service marks, designs or circuit layouts and code, whether or not now existing and whether or not registered or registrable and includes any right to apply for the registration of such rights and includes all renewals and extensions.


Jurisdiction and legal advice

These terms will be interpreted and enforced in accordance with the laws of New South Wales. You irrevocably submit to the non-exclusive jurisdiction of the Courts and Tribunals of that state. You warrant that you have been given the opportunity to seek independent legal advice in relation to these terms, and that you have either received such advice or declined to receive it, and in either event freely enter into these terms in complete understanding of all of its terms and the effect of its terms.



Where any clause or part of that clause is ineffective it may be severed without affecting any other part of these terms.



No right under these terms is waived or deemed to be waived except by notice in writing signed by the party waiving the right. A party does not waive its rights under these terms because it grants an extension or forbearance to the other party. The failure, delay or omission by a party to exercise any power or right conferred upon it by these terms will not operate as a waiver of such power or right, nor will any single exercise of any such power or right preclude any other future exercise of the power, or the exercise of any other power or right under these terms.


Assignment and novation

We may assign and/or novate our rights and obligations under these terms and all other agreements, deeds or arrangements with you to any third party and you hereby provide your consent for us to do so. You must not assign or novate your rights and/or obligations under these terms without our prior written consent.



No rules of construction or interpretation shall apply to the disadvantage of the party that has prepared these terms or wishes to rely on them or any part thereof.



Any notices or correspondence which either party may give or be required to give to each other under these terms may be delivered by e-mail, unless a different method of service is required by law. A notice under these terms is deemed to be served: if hand delivered, on delivery; if sent by prepaid post, two business days after the date of posting; and if sent by email, when the sender’s system generates a message confirming successful transmission of the entire message, but if the delivery, receipt or transmission is not on a business day or is after 5.00pm on a business day, the notice is taken to be received at 9.00am on the next business day.
